A DAY AT THE BEACH - QUESTIONS

In preparing for the meeting with McDuff and Ms. Hahn, your team has been asked by Ms. Hahn to write a complete and thorough report, addressing at a minimum the following questions:

Q. 1. McDuff’s attorney, Ms. Nicole Hahn, decided that it might be helpful to introduce data that would show that accident rates among drivers wearing flip-flops are higher than the accident rates among drivers wearing other types of footwear. Ms. Hahn obtained results of a federal government survey that produced data relating to non-fatal motor vehicle accidents and the nature of footwear that was worn by drivers at the time of the accidents. The data represented the difference between non-fatal accident rates of drivers wearing flip-flops and that of drivers wearing other types of footwear. The survey data is presented in Table 1 below. Ms. Hahn is not sure the results of the survey support the position that the accident rate among drivers wearing flip-flops is higher than the accident rate among drivers not wearing flip-flops. She is uneasy with the survey results, fearing that the survey might reveal the worse case outcome, namely, that drivers who wear flip-flops have lower accident rates than drivers who do not wear flip-flops. In addition, she is unsure how to analyze the data before making a final decision whether or not to use the survey results in settlement negotiations or, if needed, at trial. Ms. Hahn needs help in making sense of the data. Does the data support her position? In addition, Ms. Hahn is concerned about the limitations that might exist regarding the methods being used to analyze the data. Are there any recommendations that might overcome the limitations?

The Beach

...The, enclosed, beach is silent. The bright ball blinds you as it emerges; it rises like a yellow lollipop on the distant horizon. Crashing against the shore, small waves wash the night's debris onto the land. Untouched golden sand covers the floor as far as your eyes can see. Soothing, a gentle sea breeze rustles through your hair. Beach shops prepare for their day of excited costumers bustling in and out of their small seafront shops. Opening their doors, they bring out all of there beach products looking out to the sea you can see the large cruise ships on the worlds edge. Abandoned, nothing there apart from a few sea gulls pecking at the rubbish left by yesterday's visitors. Empty crisp wrappers, chocolate wrappers, ice cream papers and half eaten cones scatter the yellow sand. Young children stumble onto the moist sand, with small buckets and spades in their hands, they shout and talk in excitement. Damp sand is forced between their toes. Straight away, the young children put on their swimming costumes and are smothered with thick white sun screen, to protect them from the bright sun. Children running towards the shoreline; their parents struggle onto the sand, loaded like camels with everything they will need for their day. Sandwiches, cold drinks, wind breakers, towels all bagged up and slung over both shoulders. A hot sea breeze rushes through the visitor's hair, as you stand there you can taste the salt in the air because it is so strong. The sound of the waves......

The Beach

...Miranda Poole 2/3/13 English 101 Descriptive Essay The Beach: A Relaxing Wonderland It is spring break, in the middle of March, my junior year. As I cross the state line into Florida, I picture the ocean as being a place of peace and serenity. It’s my first time visiting the ocean, and all I can think about is hoping it is as beautiful as the pictures I have seen of it. As I arrive to the beach with all my friends, the eagerness of seeing this peaceful place is rising. I can’t wait to smell the fresh salty air, feel the soft sand between my toes, walk along the breezy shoreline. As we approach the beach, the first thing I notice is the sky. As I look into the cloudless, cerulean blue sky and see the flawlessness of life; in the distance, rolling clear-blue waves crash into each other with such force as that of football players. The sky is breathtaking along with the sounds of the waves and the tide washing onto the shore. The water reminds me of crystals shimmering in the water with the sun reflecting off of it. As the sun sets, the sky turns into a pink hue with a bright orange sun going down into the horizon. We stroll on the beach, and my feet sink into the soft sand. I stroll along, and the grainy, slick, brown sugar sand pulls my bare feet under and leaves a perfect imprint. I pick up a handful and sift it from my palm slowly, feeling the grittiness of sand with each finger. The view down the beach of the white, but slightly brown sand was enough to make my knees......

Beach

...SIESTA KEY BEACH, MY FAVORITE LOCATION Of all the places that I have visited, there has never been on that has made me feel as relaxed and content as I do at Siesta Key Beach in Sarasota, Florida. With the sound of the Gulf waters crashing on the soft white sand, the warm sun beating down and the squawking sounds of the seagulls flying overhead, I could sit there for hours. The impact that sitting on Siesta Key beach has on my sense of touch, smell and sound, is one that I have yet to experience on any other beach. I remember the first time I went to Siesta Key Beach with my family. I was about 10 years old. I remember feeling overwhelmed with excitement as I stood on the white sandy beach and looked out into the sparkling waters of the Gulf of Mexico. The sand is baby powder soft and feels wonderful on your feet. It as if you are getting your own personal pedicure with every step you take along the beach. The sand never gets hot which makes it pleasant to take long walks along the shoreline. The first time I went swimming in the Gulf of Mexico I was amazed at how warm and salty the water was. It was like taking a bath in the world’s largest bathtub. There are several outside showers along the beach for you to rinse off the dried salt left on your body after your swim. The sweet smell of the gulf waters reminds me of when I use to live on a lake. Those were such happy times for me. When I am not basking in the sun or swimming in the salty waters of the...

...writting 09-07-13 The Beach Everyone needs a break in life. Chores, school, and work are all daily duties that people want to escape from. The beach releases me from all my responsibilities, so I try to visit the beach every summer at least once. I feel that all work and no play can be socially unhealthy. There should always be time for letup. Everyone needs to get out of work mode once in a while. My cousins enjoy the beach as much as I do, and my cousins always invite me to tag along with them. When I visit the beach, I can personally say that I always create new memories. This past summer, I only got the chance to go to the beach one time, but I still had an amazing time at the beach. The day I went to the beach was perfect. The sun was high in the sky, and the clouds provided just enough shade. The weather for the whole day was beautiful. The sand on the beach was warm to the skin. It felt as if I was walking on a bunch of pillows. As soon as I sat on the beach I completely buried my feet in the sand. The waves where flowing in because of the boat traffic in the distance. The sound of the waves were almost putting me to sleep as I laid on the shore. Many people play recordings of wave sounds to put themselves asleep at night, but the real sound of waves in person is extremely move effective. The water, the sand, and the sky was just exceptional. I could not dream up a better day. The setting of the beach was just right. The great part of the beach is people......

Descriptive Day at the Beach

...Day on the Beach English 1301 Description Essay #1 Arriving at the beach my Dad bulldozed through the ever floundering sand as we swayed from side to side from his efforts. Our old car puffed with agony before he finally unearthed a parking spot neighboring the pier. Bolting out of our roadster I hammered the door shut and charged toward the pier. The soft light brown to tanish oven baked sand engulfed my feet as it muscled its way between each toe and quickly heated them. In my struggle to reach the pier I managed to stop beneath it to cool my crisp feet. I strolled along the ocean’s edge as the chilled water revived my warm feet as I felt the sand jittering in the shallow water. Rough concrete pillars each blanketed at base with slimy green and black mold were cool to the touch. Encompassing these pillars were large heavy dark rocks carpeted with gooey moss and a few with sharp pointy edges. Coupled with these pillars and rocks were small skittish sand crabs. With there hard shell, light brown color, eyes floating above their head, and legs spread apart they were very fast. Moving onward, I scrambled up the faded pier with old cracked dry wood that squeaked along the way until I reach the peak. My feet were once again warmed by the scorching wood of the pier. I tip-toed toward an orange heavy duty igloo water cooler yelling with my mouth wide open, OUCH, HOT, HOT, OU, until I cooled them down with the ice cold water. I stood near the cooler feeling the...

...A day at beach Everyone has a place where they go to escape all the pressures and worries of life. There is always that one spot that can soothe all your problems and troubles in times of stress. For me, the beach is the ultimate cure to all of my problems. While I am there, all of my obligations are suddenly erased. The day was warm and muggy; it was the perfect weather to go to the beach. The water was clear and a rich deep blue in color. Not a patch of seaweed in sight. The fine white sand is burning your feet as you hear the sound of the waves crashing and the cool sea breeze brushing by. I take a deep breath of fresh air and look at the surrounding of people soaking in the sun waiting to get in the water. I slapped on the sunscreen and packed up my gear and ran towards the water, little kids were building sandcastles and having sand fights. I dogged through them and at last I was running through the shallows of the water getting nearer to the in coming wave. I dove straight through the dumping wave, the cool water rushing down my body. I popped back up to the surface, relived that I was finally out of the warm weather and cooled off by the beautiful seawater. Later, my friends decided to join me and we played volleyball in the sand. Everyone brought snacks and later that night we also had a barbeque. After a while, we swam in the sea, which was cool and pleasant. I saw sailing boats in the distance and fishermen busy with their catch. Then we sat on the beach......

Eden Robinson's Monkey Beach is the story of Lisamarie Hill and her search for her brother, Jimmy, who is missing at sea in northern British Columbia. The first example is the government's treatment of Lisa's grandfather after he loses a leg in World War II. Lisa explains the disorganization of the government when it comes to her grandfather's compensation, “when he came home, he couldn't get a job or get the money he thought he should get from Veteran Affairs......

A Day at the Beach Legal Analysis

...LEGAL ANALYSIS Negligence The plaintiff, McDuff, is suing Jetson for liability in a negligence case. In order to prevail in a claim for negligence, the plaintiff must establish six points, referred to the law as a prima facie case. They are the following: 1. Conduct; 2. duty; 3. breach of duty; 4. actual cause; 5. proximate cause; and 6. damages Conduct and Duty In order to establish duty, there are three factors in determining whether to impose a duty at common law. They are the following: 1. The relationship between the parties; 2. the reasonable foreseeable harm to the person injured; and 3. public policy concerns The existence of any of these factors is sufficient for the court to impose a duty and although conduct is mentioned as a factor, generally, it is not discussed as an element in the prima facie case. In this case, there was no relationship between Jetson and McDuff. The next factor would be aligning the reasonable foreseeable harm to the person injured. As a general principal, a defendant owes a duty of care to all persons who are foreseeably endangered by his/her conduct, with respect to all risks which make his/her conduct unreasonably dangerous. In this case, there is reasonable foreseeable harm to the person injured because the defendant, Jetson, owed a duty of care. She had to make sure that by driving; she would pay attention to the road and make sure that she is wearing appropriate shoes for driving. We know...

A Nice Day at the Beach

...Jackson Moore November 1, 15 MKTG 3433 TLAM 9 This week’s resource is a video of Steve Easterbrook, the CEO of McDonalds, speaking on McDonalds’ needs to reconsider its business strategy and turn the company around. This video directly relates to chapter 15 of our textbook in many ways. The most obvious relationships are on target markets and customer service. One of these examples can be seen near the start of the video when Steve says that McDonalds needs to refocus and get closer to its target markets. This directly relates to the section title “Selecting Target Market” on page 493 of our textbook where it claims that, “A retailer starts to define its strategy by selecting a target market”. This is one of the most important things to consider when it comes to a company. If the company does not have a good grasp on its target market then it has no way of knowing how to tend to the demand of that market. Another connection between our reading and the video is that they both have a section devoted to customer service. Steve says that they are going to put more time and effort into focusing on the customer. He says that the company will develop a “sharper focus on the customer… a sharper focus on what they want”. On page 494, the book claims that all of this customer service is done to increase sales by attracting the target customer. Through this week’s video and reading, I have learned about many different marketing......

The Beach

...The Beach The waves are crashing. The sun is setting. People are laughing and embracing under the sunset. I feel the sand squish slowly through my toes as I gaily walk down the shoreline of the Outer Banks. My all time favorite place to be is the beach. The weather at the beach is the most quarreling of all places in the world. One minute you are relaxing lazily on the sandy seashore reading a most invigorating book. I sit engrossed and allow the foamy mist from the rampant ocean spray your face lightly as though it was the touch of a feather. Off in the distance the sun begins to set in a sleepy unhurried fashion. It is the most beautiful sight I have ever seen. The colors swirl together in a muddled mass across the sky. Crash! Flash! The sky turns wild. Lightning hurls itself across what was once the tame uncaring heaven. Thunder booms while the atmosphere relieves itself of unwanted moisture. A violent explosion of heavenly emotion has replaced my peaceful evening. What could be more exciting than living in a place where your plans could be intruded upon so abrasively by a cause you cannot control? Sand castle building is the most enjoyable and childish activity available to people over the age of ten. Building sand castles is a very creative process. First, I have to decide what type of architecture I am going to construct my castle around. The architecture can be old-fashioned, contemporary, or even imaginary...

Beach

...The Beach On a hot summer day, you would go out to the beach to enjoy the view, the weather and the water. It was a sunny Friday afternoon when I decided to take my observations with me out into the world. I find that my imagination wanders off on its own and takes trips to the ocean without me, so I figured my body had some catching up to do. With a snap of my fingers and a short ride through the mountains. I found myself at my childhood playground, Santa Cruz Beach. The location is near the ocean side, steep rocky hills to the left and sand for days to the right. I ran down to the sand as fast as I can and without hesitation I laid my towel down upon the tiny grains and chips of rocks that the oceans might had turned into sand over the years. I took a moment to put my life on hold and gaze at what nature had to offer to me. I reflected upon all of the other places I could have been instead of standing with my toes curling in the warm sandy beach and smiled in appreciation of my situation. It was perfect weather out for a day at the beach. The clear sky didn’t have a single cloud to block the rays of the radiant sun. I could sense the feeling of ultra relaxation from the outstretched deep blue canopy above and the penetrating warmth that emanated from the sky and wrapped around my skin like a warm blanket on a cold winter’s night. Every once in a while a cool breeze would pass by and ease away the sun’s intense heat bath for brief moment. I could feel grains of sand...

The Beach

...The Nights at the Beach. It’s a place where my heart lays calmly with constant beat. As I sit and look across the ocean and see the moon’s reflection on its surface, I wonder if there is any other place that could makes me feel more at peace, unharmed and relax. This is my place where I can come to rest my mind, away from all the crowds and the mixture of noise in the city. If you don’t look at the ocean closely, pay every attention to it, you might never find its specialness like the way I do. When I sit in this very spot, I can see the beautiful sunrise and enjoy the romantic moon light under the sky when it takes place. Along in the distance not too far from here, a few people had said they could see a mysterious island under the moon light. Most people believe it was just an illusion, created by the effect of the moon light reflected off the water surface. They say if you come here usually, you can tell the amazing colors of the surface change throughout the year when you look at the water. From a nature deep blue in the winter to a pale green in the summer, the amazing view is one of the memories that will stay with me from now until I die. As the tide was rising up, the mist will be twinkling down my toes and the smell of it will take over me, bring me to a stage of mind where I can only hear the sound of the ocean waves surrounding me. This is the scent of the earth being born again. The water is the one thing that centers me to earth. It has a grounding aspect......
